The immediate past Attorney General and Commissioner for Justice of Abia State, Uche Ihediwa, has been temporarily stripped of his Senior Advocate of Nigeria (SAN) title amid an investigation into allegations of professional misconduct by the Nigerian Bar Association (NBA). This decision was announced on Wednesday, July 17, 2024, by Sarki Bello, Secretary of the Legal Practitioners Privileges Committee (LPPC).
The suspension was decided at the 163rd General Meeting of the Council on July 1, 2024, following extensive deliberations on a petition filed by the NBA against Ihediwa. According to the LPPC statement, the NBA President, Yakubu Maikyau, had petitioned the Chief Justice of Nigeria (CJN) and the LPPC in December 2023, alleging professional misconduct by Ihediwa.
The petition detailed that during the 2023 International Bar Association Conference in Paris, Ihediwa made public declarations that were deemed unbecoming of his SAN status. Specifically, Ihediwa admitted that during his tenure as the Attorney General, individuals bribed their way into judicial appointments in Abia State. He claimed that as a member of the State Judicial Service Commission, he witnessed legal practitioners offering bribes up to N10 million to secure appointments as judges.
The NBA argued that by choosing an international forum to disclose such corruption rather than reporting to appropriate Nigerian authorities, Ihediwa acted unprofessionally and in a manner inconsistent with his SAN status. The NBA emphasized that his conduct tarnished the image of Nigeria's justice system before a global audience.
Moreover, the NBA highlighted Ihediwa’s refusal to cooperate with their efforts to investigate and possibly prosecute those involved in the bribery allegations. This lack of cooperation further exacerbated concerns about his professional conduct and its negative impact on the administration of justice in Nigeria.
As a result, the LPPC has suspended Ihediwa from using the SAN title and its associated privileges until the investigation is concluded. This action underscores the NBA's commitment to upholding the integrity of the legal profession and ensuring that breaches of professional ethics are addressed promptly and effectively.
