Abuja, Nigeria — The Federal High Court in Abuja has dismissed the fundamental human rights lawsuit filed by Nnamdi Kanu, the detained leader of the Indigenous People of Biafra (IPOB), against the Federal Government. The suit, which demanded N1 billion in damages, was rejected on Monday by Justice James Omotosho.
Nnamdi Kanu, through his legal team, had filed the suit under case number FHC/CS/1633/2023, alleging violations of his fundamental rights by the Department of State Services (DSS) and its Director General. The IPOB leader claimed that the DSS had infringed on his right to a fair hearing by obstructing his lawyers from having unrestricted access to him during his detention, thereby hindering his defense preparation in his ongoing criminal trial.

The court found no credible proof that DSS officials interfered with Kanu's interactions with his legal representatives, denied him unhindered access to his lawyers, or eavesdropped on their conversations. Consequently, the court determined that there was no breach of Kanu's right to a fair hearing as claimed.
"The plaintiff has failed to substantiate the allegations of rights violations. The evidence presented does not convincingly demonstrate that the DSS obstructed the plaintiff’s interactions with his lawyers or compromised the confidentiality of their communications," Justice Omotosho declared in his judgment.
